How TrailMyCar Solutions Limited collects, uses and protects your personal information, in line with the Kenya Data Protection Act 2019.
TrailMyCar Solutions Limited is committed to complying with Kenyan legislation and applicable global laws. We recognise the protection of personal data as a fundamental human right and comply with the Kenya Data Protection Act 2019.
1. Purpose
This policy governs how we treat personal information collected by telephone, through our websites and via our products and services. It applies when you accept our terms and conditions.
2. What is personal data
Personal data is any information relating to an identified or identifiable natural person, including identification and contact details, government-issued numbers, financial information, employee medical conditions, criminal records, telephone recordings, and location, speed and accident data.
3. Why we collect it
We collect data to manage communications, perform contracts, provide our services (including TMC Assist, TMC Job Assist and TMC Live), respond to requests, process contact-form submissions, provide quotations and, with consent, send marketing offers.
4. How we use and disclose it
We process information to identify users, provide personalised services, generate statistics, fulfil contracts, notify you of service changes and share data with partners and service providers where necessary. Our legal bases include consent, contract performance, legal compliance and legitimate interest.
4.1 Marketing & consent
We send marketing communications only where explicit opt-in consent has been obtained. Every communication includes an opt-out, and consent withdrawal is processed without delay.
5. Disclosures
We do not sell or disclose your personal information without consent. Third-party processors operate under written agreements with binding data-protection obligations (Data Protection Act, Section 42). Disclosure occurs only where required by law, in the public interest, or to protect against a breach or injury.

Information is collected directly from you or through our partners and service providers, except where publicly available or provided with consent.
7. Information we collect
- Identification & contact: name, address, email, telephone, gender, marital status, date of birth, passwords and activity records.
- Identification numbers: ID/passport number and vehicle registration number.
- Financial: bank account details, credit history and credit scores.
- Employee health (employees only): physical/mental health conditions and related information.
- Other sensitive: criminal records and civil litigation history.
- Telephone recordings: calls to our representatives and call centres.
- Crime investigation: information shared with insurers and law enforcement.
- Service-enabling: vehicle location, identification, driving licence number, GPS coordinates and speed data.
- Special-category: real-time speed and accident data collected for NTSA regulatory compliance.
8. Protecting your information
We use strict procedures and security features to prevent unauthorised access. You are responsible for keeping your password confidential.

10. Retention
We keep personal data only as long as necessary and in accordance with applicable laws, regulations and professional obligations. Inactive-customer data is reviewed periodically and flagged for deletion.
11. Security
We apply technical and organisational measures under the Data Protection Act 2019. Access is limited to employees with a business need, and all staff receive information-security and data-protection training.
12. Changes
We may amend this policy, with changes announced on our website.
13. Your consent
By using our services you consent to processing and disclosure of your personal information for service provision, analysis, permitted third-party sharing, web monitoring, statistical purposes and lawful law-enforcement requests.
14. Children
We do not knowingly collect children's information and will remove such data upon notification.
15. Your rights
You may request correction, restriction, destruction or deletion of inaccurate or excessive information. Your rights include withdrawing consent; objecting to processing; access; being informed; rectification; erasure; restriction; data portability; and objecting to automated decision-making or profiling. Operational messages such as payment reminders are not classified as marketing.
16. Failure to provide information
Failure to provide required information may prevent contract performance or continuation of services.
